CNOIR operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated luxury shopping experience (the "Services"). CNOIR is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms carefully. They contain important information about your legal rights, including warranty disclaimers and limitations of liability.
By visiting, interacting with or purchasing through our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use our Services.
SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these Terms, you confirm that you are at least 18 years of age or the age of majority in your jurisdiction, and that you have provided consent for any minor dependants to use the Services on devices you own or manage.
To use the Services, you may be required to provide information including your name, email address, billing and payment details, and shipping information. You represent and warrant that all information provided is accurate, current and complete, and that you hold all rights necessary to provide it.
You are solely responsible for maintaining the confidentiality and security of your account credentials and for all activity conducted through your account. You may not transfer, sell, assign, or license your account to any third party.
SECTION 2 – OUR PRODUCTS
We have made every effort to represent our products accurately. However, colours and product appearance may vary from how they appear on your screen due to your device type and display settings.
We do not warrant that the appearance or quality of any product purchased will meet your expectations or match exactly what is depicted in our online store.
All products are handcrafted and made to order. Due to the bespoke nature of production, minor variations in colour, texture, finish and construction may occur and do not constitute a defect. Product descriptions are subject to change at our sole discretion at any time without notice. We reserve the right to discontinue any product or limit availability to any person, geographic region or jurisdiction at any time.
SECTION 3 – ORDERS
When you place an order, you are making an offer to purchase. CNOIR reserves the right to accept or decline any order for any reason at its sole discretion. A binding contract is formed only when CNOIR sends you an order confirmation. Payment must be received and processed before your order is accepted.
As all items are made to order, please review your order carefully before submitting. Due to the bespoke nature of production, CNOIR may be unable to accommodate cancellation requests once an order has been accepted and production has commenced. Where an order is not accepted, amended, or cancelled, we will notify you via the contact details provided at checkout.
Your purchases are subject to our Refund Policy.
As our products are made to your specification, they are exempt from the 14-day statutory cancellation right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. This exemption applies to all made-to-order and bespoke items. Your statutory rights in respect of faulty or misdescribed goods under the Consumer Rights Act 2015 remain fully intact.
You represent and warrant that your purchases are for personal or household use and not for commercial resale or export.
SECTION 4 – PRICES AND BILLING
All prices are displayed in GBP and are subject to change without notice. The price charged will be the price confirmed in your order confirmation email. Unless expressly stated, posted prices do not include applicable taxes, shipping, handling, customs or import charges.
Prices on our online store may differ from those offered in other channels or by third parties. We may offer promotions governed by separate terms; in the event of conflict, promotion terms prevail.
You agree to provide accurate, current and complete payment and account information for all purchases. You warrant that: (i) payment information you provide is true, correct and complete; (ii) you are duly authorised to use the payment method; (iii) charges will be honoured by your payment provider; and (iv) you will pay all charges including applicable taxes and delivery fees.
SECTION 5 – SHIPPING AND DELIVERY
All delivery timelines are estimates only and are not guaranteed. We are not liable for delays caused by third-party carriers, customs processing, or events outside our reasonable control including but not limited to force majeure events.
For international orders, you are solely responsible for any applicable import duties, taxes, customs fees, or regulatory compliance requirements in your country of receipt. We are not liable for packages held or delayed by customs authorities.
Once products are transferred to the carrier, title and risk of loss pass to you. In the event of loss or damage in transit, claims must be raised with the carrier directly. We will provide reasonable assistance where possible.
SECTION 6 – INTELLECTUAL PROPERTY
All content on the Services — including but not limited to trademarks, brand identity, text, images, graphics, video, audio, product designs, and the selection and arrangement thereof — is the exclusive property of CNOIR, its affiliates or licensors, and is protected under UK and international intellectual property law including the Copyright, Designs and Patents Act 1988.
These Terms permit use of the Services for personal, non-commercial purposes only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any content from the Services without our prior written consent. Nothing in these Terms grants any licence under any patent, trademark, copyright or other intellectual property of CNOIR, Shopify or any third party, except as expressly stated. All rights not expressly granted are reserved.
CNOIR's names, logos, product and service names, designs and slogans are trademarks of CNOIR. Shopify's marks are trademarks of Shopify Inc. All other third-party marks belong to their respective owners.
SECTION 7 – OPTIONAL TOOLS
You may be provided access to third-party tools via the Services. We do not monitor, control or endorse such tools and provide access to them strictly "as is" and "as available" without warranty of any kind.
Your use of any optional third-party tools is at your sole risk and discretion. We shall have no liability arising from or relating to your use of such tools. You should review the terms of any third-party tool provider before use.
We may introduce new features or tools to the Services at any time. Such additions shall be subject to these Terms.

We are not liable for any harm, loss or damages related to your access to, or transactions with, any third-party websites or services. Any complaints or claims relating to third-party products or services should be directed to the relevant third party.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
CNOIR is powered by Shopify, which enables us to provide the Services to you. All sales and purchases made through our store are made directly with CNOIR. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of transactions between you and CNOIR, including any injury, damage or loss resulting from purchased products or services. You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with CNOIR.
SECTION 10 – DATA PROTECTION AND PRIVACY
All personal data we collect through the Services is processed in accordance with our Privacy Policy and in compliance with UK GDPR, the UK Data Protection Act 2018, and the Data (Use and Access) Act 2025. Certain personal data may also be processed by Shopify in accordance with Shopify's Privacy Policy.
Because the Services are hosted by Shopify, Shopify collects and processes certain personal data about your access to and use of the Services. Information you submit may be transmitted to Shopify and its partners, who may be located in countries other than your country of residence. Please review our Privacy Policy for full details.

By submitting any ideas, suggestions, feedback, reviews or other content ("Feedback"), you grant CNOIR a perpetual, worldwide, royalty-free, sublicensable licence to use, reproduce, modify, publish and distribute such Feedback for any purpose, including to improve and promote the Services.
You represent and warrant that: (i) you own or hold all rights to the Feedback submitted; (ii) you have disclosed any compensation or incentives received in connection with it; and (iii) your Feedback complies with these Terms. We are under no obligation to maintain confidentiality of, pay for, or respond to any Feedback.
We may, at our discretion, moderate, edit or remove Feedback that is unlawful, offensive, defamatory, obscene, or otherwise in violation of these Terms or third-party rights. You are solely responsible for the accuracy and legality of any Feedback you submit.
SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS
The Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct any such errors and to amend, update or cancel orders where inaccuracies exist, at any time without prior notice, including after an order has been submitted.

You may only use the Services for lawful purposes. You must not, directly or indirectly: (a) use the Services for any unlawful or malicious purpose; (b) violate any applicable international, national or local laws or regulations; (c) infringe the intellectual property rights of CNOIR or any third party; (d) harass, threaten, defame or harm any individual; (e) transmit false, misleading or fraudulent information; (f) send unsolicited communications including spam, phishing or chain correspondence; (g) impersonate any person or entity; or (h) engage in any conduct that restricts or inhibits any other person's use of the Services.
You further agree not to: (a) upload or transmit viruses or other malicious code; (b) reproduce, exploit or resell any portion of the Services; (c) collect personal information of other users; (d) use any automated tools, robots, scrapers, AI agents or data extraction processes to access the Services; or (e) circumvent any security, access control or anti-bot measures employed by us. We reserve the right to suspend, disable or terminate your access without notice for any breach of these Terms.
SECTION 14 – AGENTS
14.1 This section applies where you use, enable or cause any automated software or AI agent ("Agent") to access, interact with or use the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of a person or entity without direct human supervision.
14.2 No Agent may access the Services unless it identifies itself at all times and operates in accordance with section 14.4 below. No Agent may access the Services if we have directed it to refrain from doing so.
14.3 We may restrict or block Agent access to the Services at any time using technical or administrative measures.
14.4 Agents must: (i) identify themselves in all HTTP/HTTPS requests by including "Agent/[agent name]" in the user agent string; (ii) not mimic human behaviour, complete CAPTCHAs or circumvent human-verification measures; (iii) respond truthfully when asked whether interactions originate from a human or a computer; and (iv) not circumvent any measure intended to limit or control Agent access to the Services.
SECTION 15 – TERMINATION
We may terminate this agreement or your access to the Services at any time, in our sole discretion, without notice. You will remain liable for all amounts owed up to and including the date of termination.
The following sections survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive.
SECTION 16 – DISCLAIMER OF WARRANTIES
All information provided through the Services is for general information purposes only. We make no warranty as to its accuracy, completeness or fitness for any purpose. Any reliance you place on such information is strictly at your own risk.
EXCEPT AS EXPRESSLY STATED BY CNOIR, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THEM ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY REPRESENTATION, WARRANTY OR CONDITION OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. NOTHING IN THESE TERMS AFFECTS YOUR STATUTORY RIGHTS AS A CONSUMER UNDER UK LAW, INCLUDING UNDER THE CONSUMER RIGHTS ACT 2015.
SECTION 17 – LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CNOIR, ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOSS OF DATA OR REPLACEMENT COSTS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS OBTAINED THROUGH THEM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in these Terms excludes or limits liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any other liability that cannot be excluded or limited under applicable UK law.
SECTION 18 – INDEMNIFICATION
You agree to indemnify, defend and hold harmless CNOIR, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from and against any losses, damages, liabilities and claims, including reasonable legal fees, arising out of or relating to: (1) your breach of these Terms or any document incorporated by reference; (2) your violation of any applicable law or third-party rights; or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim. Failure to notify promptly will not relieve you of your obligations unless you are materially prejudiced thereby. We may control the defence and settlement of any such claim at your expense, but will not settle any claim imposing non-monetary obligations on you without your prior consent (not to be unreasonably withheld). You agree to cooperate reasonably in the defence of any indemnified claims.
SECTION 19 – SEVERABILITY
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the unenforceable portion shall be severed from these Terms without affecting the validity and enforceability of the remaining provisions.
SECTION 20 – WAIVER; ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
These Terms, together with all policies and operating rules referenced herein, constitute the entire agreement between you and CNOIR regarding the Services and supersede all prior agreements, communications and proposals, whether oral or written.
Any ambiguities in these Terms shall not be construed against CNOIR as the drafting party.
SECTION 21 – ASSIGNMENT
You may not assign, delegate or transfer this agreement or any rights or obligations under it without our prior written consent; any such attempted transfer is null and void. We may transfer, assign or delegate these Terms and our rights and obligations at any time without notice to you.
SECTION 22 – GOVERNING LAW
These Terms and any agreements through which we provide the Services shall be governed by and construed in accordance with the laws of England and Wales. You and CNOIR submit to the exclusive jurisdiction of the courts of England and Wales for the resolution of any disputes, without prejudice to any mandatory rights you may have as a consumer under your local law.

SECTION 24 – CHANGES TO TERMS OF SERVICE
The most current version of these Terms will always be published at this URL. We reserve the right to update, change or replace any part of these Terms at our sole discretion. We will notify you of any material changes in accordance with applicable law, and changes will take effect on the date specified in the notice. Your continued use of the Services following any update constitutes your acceptance of the revised Terms.
